We provide Amazon advertising management, listing optimization, creative services, brand management, and related e-commerce services for sellers and brands.
Use of the Site
You may use the Site for lawful purposes only. You agree not to misuse the Site, attempt to gain unauthorized access to it, interfere with its normal operation, or use it to infringe the rights of others. We may modify, suspend, or discontinue any part of the Site at any time without notice.
Our services
Descriptions of services on the Site are for general information and do not constitute a binding offer. The specific scope, deliverables, fees, and timelines for any engagement are defined in a separate written agreement, proposal, or statement of work between you and NextGen Profit Lab. Where those documents conflict with the Site, the signed engagement documents control.
Free brand audit
We offer a free Amazon brand audit and SWOT analysis. Submitting a request does not create an ongoing service relationship or any obligation on either party. We may decline or limit audit requests at our discretion. Any audit is provided for your information only and does not guarantee particular outcomes.
No guarantee of results
We apply professional expertise and industry best practices to grow and optimize your Amazon presence. However, results depend on many factors outside our control, including your products, pricing, inventory, competition, and changes to Amazon’s policies and algorithms. Case studies, testimonials, and performance figures shown on the Site reflect specific past client results and are not a promise or guarantee of future performance for any other brand.
Client responsibilities
Where you engage us, you agree to provide accurate information, timely access to the accounts and materials needed to deliver the services, and prompt responses to requests for approval or input. You are responsible for ensuring that your products, listings, and business comply with Amazon’s policies and applicable law.
Account access and confidentiality
Where an engagement requires access to your Amazon Seller Central or advertising account, access is granted on a permission basis and used solely to perform the services you have requested. Our handling of your information is described in our Privacy Policy. Where an engagement involves confidential information, both parties’ obligations are governed by the confidentiality terms in the applicable engagement agreement.
Fees and payment
Fees, payment schedules, and refund terms are set out in your engagement agreement. Unless otherwise agreed in writing, fees are due as invoiced and are non-refundable once services have been performed. Advertising spend on Amazon is separate from our service fees and is paid by you directly to Amazon.
Intellectual property
All content on the Site — including text, graphics, logos, and design — is owned by or licensed to NextGen Profit Lab and is protected by applicable intellectual property laws. You may not copy, reproduce, or reuse it without our written permission. Deliverables created for you under an engagement are governed by that engagement’s terms; content and materials you provide to us remain yours.
Third-party links and marketplaces
The Site may reference or link to third-party websites and platforms, including Amazon. We are not responsible for the content, policies, or practices of any third party. Amazon, Amazon Advertising, and all related logos are trademarks of Amazon.com, Inc. or its affiliates. NextGen Profit Lab is an independent service provider and is not endorsed by, affiliated with, or acting on behalf of Amazon.
Disclaimer of warranties
The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, NextGen Profit Lab will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or our services. Our total liability for any claim relating to the services will not exceed the amount you paid us for the services giving rise to the claim in the three months preceding the event.
Indemnification

Term and termination
Either party may end an engagement in accordance with the terms of the applicable engagement agreement. We may restrict or terminate your access to the Site at any time if you violate these Terms. On termination, we remove our access to your accounts and return or delete working files on request, as described in our Privacy Policy.
Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Your continued use of the Site after changes are posted means you accept the revised Terms.
